Terms of Service

1. Agreement to Terms
By accessing or using Calvio's website (calvio.io) or services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our services. These Terms apply to all visitors, users, and business customers of Calvio.
2. Description of Service
Calvio provides an AI-powered voice follow-up platform that enables home service businesses to automatically contact their customers after service calls, collect feedback and NPS scores, detect customer dissatisfaction, and receive real-time alerts about at-risk customer relationships. The platform integrates with field service management tools including ServiceTitan, Jobber, and HouseCall Pro.
3. Eligibility and Account Registration
To use Calvio's paid services, you must:
- Be at least 18 years of age
- Be a legally operating business or authorized representative of one
- Provide accurate, complete, and current business information
- Maintain the security of your account credentials
You are responsible for all activity under your account.
4. Acceptable Use and Compliance
By using Calvio, you agree that you are solely responsible for ensuring your use of AI voice calls complies with all applicable laws, including:
- The Telephone Consumer Protection Act (TCPA) and FCC regulations
- California's Invasion of Privacy Act (CIPA) — California is a two-party consent state for call recording
- The FTC's Telemarketing Sales Rule and AI impersonation guidelines (2024)
- Any other federal, state, or local laws applicable to automated calling and customer communications
You may not use Calvio to:
- Contact individuals who have opted out of automated calls or placed themselves on do-not-call registries
- Conduct calls for purposes other than legitimate post-service customer follow-up
- Deceive customers about the automated nature of the call
- Violate any applicable consumer protection law
5. Payment and Billing
Pricing for Calvio's services is provided upon booking a demo call. All fees are billed in advance on a monthly basis unless otherwise agreed. There are no long-term contracts. You may cancel at any time, effective at the end of your current billing period. No refunds are provided for partial months.
6. Intellectual Property
All content, software, and technology comprising the Calvio platform is owned by Calvio and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for your internal business purposes during the term of your subscription. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
7. Data Ownership
You retain ownership of your business data (customer contact lists, call transcripts, NPS scores). By using the platform, you grant Calvio a limited license to process this data solely to provide the contracted services. We do not use your customer data to train AI models or for any purpose outside of providing the Calvio service to you.
8. Disclaimers and Limitation of Liability
The Calvio platform is provided “as is” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free.
To the maximum extent permitted by California law, Calvio's total liability to you for any claims arising from use of the platform shall not exceed the total fees you paid to Calvio in the three months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, customers, or business opportunities.
9. Indemnification
You agree to indemnify and hold harmless Calvio, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any applicable law including TCPA compliance obligations.
10. Termination
Either party may terminate the service relationship at any time. Calvio reserves the right to suspend or terminate accounts that violate these Terms, applicable law, or that present a risk to other users or third parties. Upon termination, your data will be available for export for 30 days, after which it will be securely deleted per our data retention policy.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration in California under JAMS rules, except that either party may seek injunctive relief in a California court for intellectual property violations.
12. Changes to Terms
We may update these Terms periodically. We will notify active customers of material changes via email at least 30 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
